Competition Terms and Conditions 

  1. By entering the "Smiling Mind Shannon Bennett Melbourne Lunch" competition (Competition), you acknowledge that you have read these terms and conditions and that you agree to be bound by them. Information on how to enter forms part of these terms and conditions.

  2. This competition is being run by Smiling Mind Pty Ltd ACN 161 428 459 of 26-28 Easey St Collingwood VIC 3066 Australia (Promoter).  To contact the Promoter, please email sol@smilingmind.com.au

    WHO CAN ENTER?

  3. To be eligible to enter the Competition the entrant must: 

    (a) be an Australian citizen aged 18 years or over as at 12:01am AEST on 15 September 2025.

    HOW TO ENTER

  4. The Competition period commences at 12:01am AEST on Monday 15 September 2025 AEST and ends at 11:59pm on Sunday 21 September 2025 AEST (Competition Period). 

  5. The Promoter reserves the right, at any time, to extend or change the Competition start and end date at any time (subject to regulatory approval). 

  6. No late entries will be accepted.

  7. To enter, visit https://www.smilingmind.com.au/lunchwithshannon complete all required fields on the entry form, and submit during the Competition Period.

  8. Incomplete or incoherent entries will be invalid.

  9. A limit of one entry to the Competition per person applies. Multiple entries by the same person will be invalid. In the instance of multiple entries, the earliest entry by date will be entered into the Competition. 

  10. To the extent permitted by law, the Promoter does not take responsibility for any entries not received for whatever reason.

  11. The Promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this Competition.

  12. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.

    PRIZE

  13. The prize is as follows:
    One winning person will be selected by chance, to win the following prize:

    • A lunch sitting with one guest of their choice, with Shannon Bennett at BistroX Pop-Up in Fitzroy, Victoria, to be scheduled on Friday 26 September 2025 at 1:00pm AEST. It is the person’s responsibility to ensure they, and their guest are able to travel to the BistroX Pop-Up in Fitzroy and cover any associated travel costs to attend the scheduled lunch (Prize).  

  14. The Prize is valued at AUD $400.00 as at the date of publication of these terms and conditions. 

  15. The Prize does not include any costs associated with redeeming the Prize such as travel which winners will have to pay for, noting that the winner/s must not be required to incur a cost to accept a prize (other than a trivial cost).

  16. The Prize is as stated. No part of the Prize is exchangeable or  redeemable for cash or any other Prize. 

  17. The Prize is not transferable to another person. 

  18. If the Prize is not available for any reason, the Promoter reserves the right to substitute the Prize with another similar item of equal or greater  value if the winner agrees in writing and subject to any approvals from regulatory authorities. If the winner does not agree despite reasonable attempts by the Promoter to reach an agreement and the Prize is not available due to circumstances beyond the Promoter's control, the Promoter may substitute the Prize with another similar item or items determined by the Promoter to be of equal or higher value.

    SELECTION OF WINNER

  19. The winner will be chosen by manual draw on Monday 22 September 2025 at 11:00am AEST in Melbourne, Victoria (Winner).

  20. The Winner will be personally notified by email and telephone by Monday 22 September 2025 at 5:00pm AEST.

  21. The Promoter’s decision will be final and binding and no correspondence will be entered into in relation to the results of the Competition. 

    SECOND CHANCE DRAW

  22. If a Winner does not respond within 1 day of being notified that they have won the competition, that Winner is not readily identified and reasonable efforts by the Promoter to identify the Winner are unsuccessful, the Winner will forfeit their Prize and the Promoter reserves the right select another winner through a second chance draw (Replacement Winner).

  23. If necessary, a second chance draw will be held on Wednesday 24 September 2025 at the same time and place as the first draw.  The first valid entry drawn will win any unclaimed prize.  

  24. The Replacement Winner will be personally notified by email and telephone by Wednesday 24 September 2025.

  25. The results of any second chance draw will be final and binding and no correspondence will be entered into in relation to the results of the draw.

    STANDARD TERMS

  26.  Subject to regulatory approval, the Promoter reserves the right to amend the Competition and its terms and conditions at any time and for any reason, and will notify entrants of any such amendments as soon as reasonably practicable via email. It is the entrant's responsibility to regularly check their email for any amendments.

  27. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the Promoter's liability in relation to the consumer guarantees under the Australian Consumer Law (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury, or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Competition including:

    (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); 

    (b) any theft, unauthorised access or third party interference; 

    (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

    (d) any variation in Prize value to that stated in these terms and conditions; 

    (e) any tax liability incurred by the winner or entrant; or 

    (f) use of the Prize.

  28. To the extent permitted by law (including the Australian Consumer Law), if the Competition is not capable of running as planned, including by reason of technical failure, fraud, or any cause beyond the Promoter's control, the Promoter may cancel or suspend the Competition or invalidate any affected entries, subject to regulatory approval.

  29. By entering the Competition, the Winner (or Replacement Winner) agrees to participate in such promotional activity as the Promoter may require without remuneration such as featuring in marketing material without any payment to the Winner (or Replacement Winner). 

  30. The Promoter collects personal information in order to conduct the Competition, comply with its legal obligations as the Promoter and for promotional purposes. For these purposes, the Promoter may disclose such personal information to related companies, agents, regulatory bodies, contractors, service providers and any company with whom the Promoter is running the Competition. These recipients may be located overseas. If you do not provide all the personal information we request, you may not be able to participate in the Competition.  

  31. By entering the Competition, you consent to the Promoter using personal information to send you information about the competition. 

  32. Please read the Promoter's privacy policy available on the Promoter's website at https://www.smilingmind.com.au/privacy-and-terms for more information about how the Promoter handles personal information, how to access and correct your personal information, how to make a complaint, and how the Promoter handles complaints. 

  33. By participating in this Competition, entrants release and hold harmless Facebook, Instagram, and LinkedIn from any and all liability associated with this Competition to the extent permitted by law (in which case that liability is limited to the maximum extent permitted by law). The Promoter and entrants acknowledge that this Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram and LinkedIn. Entrants acknowledge that they are providing information to the Promoter and not to Facebook, Instagram and LinkedIn.

  34.  The Promoter is not liable for any tax implications arising from prize winnings, including fringe benefits tax. Independent financial advice should be sought.

  35. The laws of Victoria apply to this Competition. Entrants submit to the non-exclusive jurisdiction of the laws of Victoria.
